Warranty Agreement
1. Workmanship Warranty:
The Company warrants all workmanship for a period of ten (10) years from the date of completion. The warranty covers any defects that may arise due to poor installation techniques, incorrect procedures, or negligence in carrying out the roofing project.
2. Coverage:
a. The warranty provided by the Company shall solely cover the quality of workmanship and installation of materials. The Company does not warrant the materials or products used, as those items are subject to their separate manufacturer’s warranties.
b. The warranty shall only remain valid if the Customer utilizes materials recommended by the Company or those provided by reputable manufacturers suggested by the Company. Any issues arising due to the use of non-approved materials by the Customer shall not be covered under this warranty.
c. This warranty applies to the Customer, their immediate successors, or subsequent owners of the property on which the roofing work has been performed. It is non-transferable to any other party without prior written consent from the Company.
3. Warranty Claims:
a. In the event of a claim under this warranty, the Customer must notify the Company in writing within five (5) days of discovering the issue. Notification should include a detailed description of the problem and any supporting evidence such as photographs, videos, or other relevant documentation.
b. The Company shall have the right to inspect the alleged defect before undertaking any repairs or replacements.
c. Upon acceptance of a valid claim, the Company shall, at its sole discretion, either repair or replace the defective workmanship or materials free of charge.
d. Unless otherwise agreed upon, the Company shall not be responsible for any consequential or incidental damages arising from the defect.
4. Exclusions:
a.This warranty does not cover damages caused by acts of natural disasters, accidents, negligence, misuse, alterations, or c. any unauthorized repairs or modifications initiated by parties other than the Company.
b. Any damages caused by failure to maintain the roof in accordance with the Company’s recommendations, including routine inspections, cleaning, and appropriate care, shall not be covered under this warranty.
c. Normal wear and tear of the roof, including weathering, discoloration, or deterioration due to aging, is not covered under this warranty.
5. Governing Law:
This Agreement shall be governed by and construed in accordance with the laws of Victoria. Any disputes arising out of this Agreement shall be resolved through amicable negotiations between the parties. In case of failure to reach a resolution, the matter shall be subject to the exclusive jurisdiction of the courts VBA.
6. Entire Agreement:
This Agreement constitutes the entire agreement between the Company and the Customer, superseding all prior discussions, understandings, or agreements, whether written or oral. IN WITNESS WHEREOF, the undersigned parties have executed this Warranty Agreement as of the date first written above.
